  5. Corporate and Governmental Site License
  6.  
  7. This is a license for use of the software within your company or
  8. goverment agency, and is not transferable.  This allows internal
  9. use and copying of the software for as many sites / computers as
  10. contracted for.  (See the LICENSE.TXT file for Site License price
  11. schedule).  An unlimited Site License allows unlimited copying
  12. of the software for internal use by your company or government
  13. agency.  Distributing, repackaging, or reselling of the software
  14. to third parties is not allowed.  All licenses are prepaid.

  17. Private Use

  19. This license is not necessary for clubs or user groups distributing 
  20. the software on a SHAREWARE basis, providing that the entire 
  21. BBSsort package with accompanying documentation files is included
  22. in the distribution, and no more than a nominal fee (not to exceed
  23. $10) is charged for such distribution.

  28. It is the policy of Superior Software Corporation not to release source code of
  29. its products.

  42. This is a perpetual license for the use of the software within your 
  43. company, and is not transferable.  This license allows internal use and 
  44. copying of the software by as many users/ machines as contracted for.  
  45. Distribution, repackaging, or reselling of the software, to third 
  46. parties, is not allowed under this agreement.

  48. The LICENSOR warrants that it is sole owner of the software and has full 
  49. power and authority to grant this license herein without consent of any 
  50. other party.

  52. SUPERIOR SOFTWARE hereby disclaims all warranties relating to this software, 
  53. whether express or implied, including without limitation any implied 
  54. warranties of merchantability or fitness for a particular purpose. 
  55. SUPERIOR SOFTWARE will not be liable for any special, incidental, 
  56. consequential, indirect or similar damages due to loss of data or any other 
  57. reason, even if PKWARE or an agent of PKWARE has been advised of the 
  58. possibility of such damages.  In no event shall PKWARE's liability for any 
  59. damages ever exceed the price paid for the license to use the software, 
  60. regardless of the form of the claim.  The person using the software 
  61. bears all risk as to the quality and performance of the software.

  63. This agreement shall be construed and enforced in accordance with the 
  64. laws of the STATE OF KANSAS.  Any action or proceeding brought by 
  65. either party against the other arising out of or related to this 
  66. agreement shall be brought only in a STATE or FEDERAL COURT of competent 
  67. jurisdiction located in Johnson county, Kansas.  The parties hereby 
  68. consent to in personam jurisdiction of said courts.
